1. Contract conclusion and registration
Registration and enrollment fee: Registration must be in writing and is binding. The contract is concluded upon payment of the enrollment fee.
Contract duration: The contract is valid for the duration of one school year and is automatically extended unless it is terminated in due time.
Contracting party: The contract is concluded with Lumina Consulting GmbH, 8954 Geroldswil, as the operator of the LMS private school.
2. Tuition fees and payment terms
Tuition: Tuition covers all regular lessons. A flexible model is available, allowing for the addition of extra care on Wednesday and/or Friday afternoons, weekly holiday care, and the school bus service. These additional services are billed separately.
Payment: Tuition fees are payable in advance, either annually, semi-annually, or monthly. Late payments may incur reminder fees.
Total amount: The total amount payable upon conclusion of the contract includes the tuition fees, the registration fee, and all additional services booked (e.g., school bus, holiday care).
3. Termination and cancellation of the contract
Notice period: The contract can be terminated in writing with three months' notice to the end of the school year.
Extraordinary termination: In the event of serious violations of the school rules or failure to meet payment obligations, the school may terminate the contract without notice.
4. Lessons and school rules
Lesson times: Lesson times are set out in the school calendar. Changes will be announced in a timely manner.
Attendance: Regular attendance at classes and school events is mandatory. Absences must be reported in writing by the parents.
5. Force Majeure
School closure: In the event of force majeure (e.g., natural disasters, pandemics), the school reserves the right to temporarily suspend classes or continue them in an alternative format. The contract remains in effect in these cases.
6. Liability and Insurance
Liability: The school is not liable for students' personal belongings that are damaged or lost.
Insurance: Students are insured by the school against accidents during school hours and at school events. Additional private insurance is recommended.
7. Place of jurisdiction
Jurisdiction: The place of jurisdiction for all disputes arising from this contract is Zurich.
8. Data protection and personal rights
Data protection: All personal data of students and parents will be treated confidentially and used only within the framework of legal regulations. Data will not be passed on to third parties without explicit consent.
Photography and video recordings: Photos and videos taken during school activities may be used for internal and external school communication purposes. Parents must give their written consent for this.
9. Health and Safety
Medical emergencies: Parents must inform the school about any health conditions their child may have. In the event of a medical emergency, the school will take the necessary measures and notify the parents immediately.
Insurance: The school offers accident insurance for all students during school hours and at school events. Additional private insurance is recommended.
10. Code of Conduct and Disciplinary Measures
Code of Conduct: All students are required to treat each other and teachers with respect. Violence, bullying, and discriminatory behavior will not be tolerated. The school rules apply.
Disciplinary measures: In case of violations of the code of conduct and the school regulations, measures such as talks with the parents, written warnings or, in serious cases, expulsion from the school may be taken.
11. Participation in school activities
Mandatory activities: Participation in all school activities, including excursions and project weeks, is mandatory. Exceptions must be agreed upon with the school administration in advance.
Extracurricular activities: In addition to regular lessons, the school offers various extracurricular activities, which are voluntary but encouraged.
12. Changes to the Terms and Conditions
Subject to change: The school reserves the right to change these terms and conditions at any time. Parents will be notified of any changes in writing in a timely manner.

General Terms and Conditions (GTC) of the LMS Kita
Scope
These General Terms and Conditions (GTC) govern the contractual relationship between Lumina Consulting GmbH, as the operator of the LMS Kita (daycare center), and the parents or guardians of the children in its care. The GTC form an integral part of the respective childcare contract with the LMS Kita.
Admission and care
A child's admission is based on a validly signed childcare contract and is subject to the availability of places. There is no entitlement to admission or continued childcare.
Scope of care
The scope of care is determined by the individually agreed-upon care model as outlined in the care contract. LMS Kita is committed to providing age-appropriate, professional, and responsible care within the framework of legal requirements. There is no entitlement to a specific group composition or specific caregivers.
Opening hours, public holidays and company holidays
The regular opening hours of the LMS Kita will be communicated separately.
The daycare center is open as usual during school holidays, unless it is closed for operational holidays.
Public holidays and company holidays will be announced in good time.
On the eve of public holidays, the daycare center closes one hour earlier.
Daycare fees and payment methods
The daycare fees depend on the care model agreed upon in the care contract.
The fees must be paid in advance.
Additional services or special expenses may be billed separately.
The registration fee is a one-time payment and is due before the child's enrollment.
Contract duration and termination
The care contract is concluded for an indefinite period. It can be terminated by either party in writing with three months' notice, effective at the end of a month.
Extraordinary termination
In the event of serious breaches of contract or failure to meet financial obligations, LMS Kita is entitled to terminate the childcare contract without notice.
Absences, illness and accident
Absences or delays must be reported to the LMS Kita (daycare center) as soon as possible.
Children with contagious diseases or fever above 38°C are not allowed to attend daycare.
In the event of accidents or medical emergencies, the daycare management is authorized to take all necessary measures and to inform the parents immediately.
Data protection
Personal data of the child and their legal guardians will be treated confidentially and processed exclusively within the framework of legal regulations. Data will only be disclosed to competent authorities if legally required.
Photo and video recordings
To protect the children, we generally do not photograph or film recognizable faces.
For special projects such as film or documentary projects, the use of image or video material only occurs with the express written consent of all affected legal guardians.
Liability and insurance
LMS Kita accepts no liability for lost or damaged personal belongings.
Liability, health and accident insurance for the child is the responsibility of the parents or guardians.
Changes to the Terms and Conditions
Changes to these terms and conditions will be communicated to the parents/guardians in a timely manner and will apply to future matters.
Final Provisions
Swiss law applies.
The place of jurisdiction is Geroldswil.
