Terms and Conditions, LMS Private School

1. Conclusion of Contract and Enrolment

Enrolment and enrolment fee: Enrolment is made in writing and is binding. The contract comes into effect once the enrolment fee has been paid.
Term of contract: The contract applies for one school year and is renewed automatically unless terminated in due time.
Contracting party: The contract is concluded with Lumina Consulting GmbH, 8954 Geroldswil, as the operator of LMS Private School.

2. Tuition and Terms of Payment

Tuition: Tuition covers all regular teaching. Under a flexible model, additional care on Wednesday and/or Friday afternoons, weekly holiday care and the school bus service can be added. These additional services are invoiced separately.
Payment: Tuition is paid in advance, annually, half-yearly or monthly. Late payments may incur reminder fees.
Total amount: The total amount on conclusion of the contract comprises the tuition, the enrolment fee and all additionally booked services (e.g. school bus, holiday care).

3. Notice and Termination

Notice period: The contract can be terminated in writing with three months’ notice to the end of the school year.
Extraordinary termination: In the event of serious breaches of the school rules or failure to meet payment obligations, the school may terminate the contract without notice.

4. Lessons and School Rules

Lesson times: Lesson times are set out in the school calendar. Changes are announced in good time.
Attendance: Regular attendance at lessons and school events is compulsory. Parents must give written notice of absences.

5. Force Majeure

School closure: In the event of force majeure (e.g. natural disasters, pandemics), the school reserves the right to suspend lessons temporarily or to continue them in an alternative form. The contract remains in force in such cases.

6. Liability and Insurance

Liability: The school is not liable for students’ personal belongings that are damaged or lost.
Insurance: Students are insured by the school against accidents during lessons and at school events. Additional private insurance is recommended.

7. Place of Jurisdiction

Place of jurisdiction: The place of jurisdiction for all disputes arising from this contract is Geroldswil.

8. Data Protection and Personal Rights

Data protection: All personal data of students and parents is treated confidentially and used only within the framework of the law. It is not passed on to third parties without express consent.
Photos and videos: Photos and videos taken during school activities may be used for the school’s internal and external communication. Parents must give written consent for this.

9. Health and Safety

Medical emergencies: Parents must inform the school of any health conditions of their child. In a medical emergency, the school will take the necessary measures and notify the parents immediately.
Insurance: The school provides accident insurance for all students during school time and at school events. Additional private insurance is recommended.

10. Code of Conduct and Disciplinary Measures

Code of conduct: All students are required to treat each other and the teachers with respect. Violence, bullying and discriminatory behaviour are not tolerated. The school regulations apply.
Disciplinary measures: Breaches of the code of conduct and the school regulations may lead to measures such as meetings with the parents, written warnings or, in serious cases, exclusion from the school.

11. Participation in School Activities

Compulsory activities: Participation in all school activities, including excursions and project weeks, is compulsory. Exceptions must be agreed in advance with the school management.
Extracurricular activities: In addition to regular lessons, the school offers various extracurricular activities, which are voluntary but encouraged.

12. Changes to the Terms and Conditions

Right to amend: The school reserves the right to amend these terms and conditions at any time. Parents will be informed of changes in writing in good time.
