Terms and Conditions, LMS Daycare

Scope

These general terms and conditions (GTC) govern the contractual relationship between Lumina Consulting GmbH, as the operator of LMS Daycare, and the legal guardians of the children in its care. The GTC form an integral part of each LMS Daycare care contract.

Admission and Care

A child is admitted on the basis of a validly signed care contract and subject to the places available. There is no entitlement to admission or to the continuation of care.

Scope of Care

The scope of care follows the individually agreed care model set out in the care contract. LMS Daycare undertakes to provide age-appropriate, professional and responsible care within the legal requirements. There is no entitlement to a particular group composition or to particular caregivers.

Opening Hours, Public Holidays and Closures

The regular opening hours of LMS Daycare are communicated separately.

The daycare is regularly open during the school holidays unless it is closed for company holidays.

Public holidays and company holidays are announced in good time.
On the day before a public holiday, the daycare closes one hour earlier.

Daycare Fees and Terms of Payment

Daycare fees follow the care model agreed in the care contract.

Fees are payable in advance.

Additional services or special expenses may be invoiced separately.

The enrolment fee is a one-off payment due before the child starts.

Term and Termination

The care contract is concluded for an indefinite period. Either party may terminate it in writing with three months’ notice to the end of a month.

Extraordinary Termination

In the event of serious breaches of contract or failure to meet financial obligations, LMS Daycare is entitled to terminate the care contract without notice.

Absences, Illness and Accidents

Absences or late arrivals must be reported to LMS Daycare in good time.

Children with infectious illnesses or a fever above 38 °C may not attend the daycare.

In the event of accidents or medical emergencies, the daycare management is entitled to arrange all necessary measures and will inform the legal guardians immediately.

Data Protection

Personal data of the child and the legal guardians is treated confidentially and processed only within the legal provisions. Data is passed on only to the competent authorities where required by law.

Photos and Videos

To protect the children, recognisable faces are generally not photographed or filmed.

For special projects such as film or documentation projects, photos or video material are used only with the express written consent of all legal guardians concerned.

Liability and Insurance

LMS Daycare accepts no liability for lost or damaged personal belongings.

Liability, health and accident insurance for the child are the responsibility of the legal guardians.

Changes to the Terms and Conditions

Changes to these GTC are communicated to the legal guardians in good time and apply to future matters.

Final Provisions

Swiss law applies.
The place of jurisdiction is Geroldswil.
